Chapter 19 — Macer Moves
The ferry at the ridge crossing went in for repair on the morning after the fair, and it was, Chresimus observed, in excellent repair when it went in.
October was the month the valley packed its year for the water. Sailing had a floor under it still, but everyone could feel the boards thinning: the masters at Portus Albus talked of the sea the way the vega had talked of the sky in March, and every cargo the district meant to turn into winter coin — the last of the wool clip, hides, the summer's amphorae, the first pressings if the mills ran early — stood on the quays or in the warehouses behind them, waiting its barge, and every barge waited its lighter, and the lighters, that month, had business elsewhere. Not refusals. There was not a refusal to be had in the whole reach of the river, at any price, in any form a man could carry to a magistrate. There were engagements. The Tarbessan lighters — half the shallow hulls on that water — were engaged, truly engaged, on contracts with dates on them; the ferry that shortened the ridge road by a day was up on the bank with men adzing thoughtfully at wood that had wintered forty years without attention; at the seagoing berths downriver the Cardena consignments waited their lawful turn, and the turn was lawful, and long.
Chresimus gave him the month across the customs bench, the account-roll open between them out of old habit, though what they were reckoning that morning stood in no column of the farm.
"Nothing has been refused, commissioner. Attend to that; it is the whole cargo. A refusal is a young man's instrument — it can be written down, sworn to, sent down the river in a case with a seal on it. What we have had is a season. Delay is weather. Every eight days a cargo misses is a rung down a ladder, and the ladder ends in the mud: miss the last barge and your goods winter here, and wintered goods must be fed — roof-rent, wastage, and the money they stand on carried at the winter rate. I have weighed the month for you." He had; he laid it out, shipper by shipper, in his freight-man's tale where everything was a cargo and every cargo had a cost, and the sum of what October had quietly taken from the district was more than the portorium would take in a season; "and no man has it, excellency. That is the beauty of it, if you are minded to see beauty. It has not been taken; it has only been lost. Who will you charge with October?"
And then, rolling the account-roll closed, in the tone he kept for facts he was selling cheap because their weight would be paid for elsewhere: "One thing more, as freight, not opinion — opinion is not in my farm. On the last strong water the Tarbessan boat went down with a case of documents aboard, corded and sealed, and an advocate's slave riding beside it like kin beside a coffin. Sealed writings pay no toll and answer no questions. I weighed it." A pause of the professional kind. "It weighed what petitions weigh."
In the spring Marcellus had read the drought in the racks before he believed it in the sky, and in October he read the war the same way, in the only prose the district never falsified. The notaries' rolls came up under the standing order, and the month was written there in instruments: renewals refused where renewal had been the custom of decades; sureties freshly demanded of men whose bare word had served their fathers; demands entered at law, in proper form, with courteous speed, on debts that had slept for years and woken all together, like birds off a field. He laid the demands beside his own lists — the deposition witnesses, sworn at the stones; the causes standing on the new register of appeals — and the lists kept company. Not perfectly: a careful man had seen to the imperfection; there were demands against men who had sworn nothing, renewals granted to one appellant in three, enough grain in the pattern to feed any advocate who came looking for one. But the weight of it lay where the weight of everything in the valley lay. Prudence answers no summons. The correction itself had armed it: a register in motion is a poor pledge, and the lenders whose paper girdled the vega had the law's own leave to look to their securities while titles stood open — his truth, gone over the ridge and come back with its edge turned. Every demand entered that month was better founded because the register was truer. That was the artistry of it, and he sat with the rolls in the evenings and gave it, in the privacy the book enforced, its due: he had corrected the writing, and the writing, corrected, had gone to work for the other side, because the other side owned everything in the valley but the writing, and needed only that the writing be believed.
The town felt it before it understood it, and blamed him before it felt it fully, because the shape of the thing was visible from any oven-queue in Cardena: the corrections had gone up the vega in September, and in October the coin went home to Tarbessa, and between one nundinae and the next the district composed, in its immemorial workshop, the sentence that would meet him at the gates for a year: he woke the writing, and the coin flew. At the ordo's session the town's quaestor read the winter's obligations in a voice that got quieter as the sums got larger, and came in time to the grain — the balance of the summer's purchase falling due at the Saturnalia, two months out, a figure the chest could meet if the year shed no more feathers — and the room did not look at Marcellus, which was how he knew it was looking at nothing else. It was Vetus who said it, from the old benches, without rising, courteous as winter.
"No man of Tarbessa has broken any law in my hearing, excellency. They have only remembered, all in one month, to be careful. Credit is like water; it runs from noise. The old know this, and forgive it, and keep their voices low." He looked at his hands. "The town asks — I do not ask it; I am past the age of needing answers — the town asks what it was, this year, that made the noise."
There was no answer to give that the room did not already hold by heart, in both versions: his — that the noise was the sound of thirty years of theft being written down; and the room's — that the theft had fed them, in its fashion, and the writing-down did not; and he made the only reply that kept both versions standing, which was to move that the collection proceed on the published assessment, and to note, for the roll, that the district's obligations to its neighbors would be met to the day. Silo seconded it. Silo's seconds had grown one syllable shorter each month since September; the Latium project wanted the province's goodwill the way the vega wanted rain, and honors to the new proconsul had been voted in Tarbessa, not here, and every man in the curia could do that sum without a counting-board.
Macer's letter came on the last day but one of the month, by his own courier, sealed with the ring Marcellus had last seen pressed into wax across a dinner it had cost him a winter's thought to leave empty-handed. It regretted the season. It hoped the reports from Cardena overstated, as reports did, the shyness of the year's credit; some, he heard, laid it at the doors of the Tarbessan houses; old men could not govern what was said of them. Then, in the plain style he kept for the sentences that mattered, the way other men raise their voices: A register in motion is a poor pledge, commissioner. Men who lend against land must know whose the land is. You are making that a question — with the best right in the world; I have said so at my own table — and until it is an answer again, prudence will keep its coin at home. This is not enmity. It is the arithmetic you yourself serve, and I honor it. When your register comes to rest, credit will find its level, as water does. We trust the town stands provided for the winter; the balance of the summer's grain falls due, as agreed, between neighbors, at the Saturnalia. He read it twice, and set it on the shelf of instruments whose every sentence was true — it was becoming, that shelf, the best-furnished room in his keeping — and answered it the same evening in two sentences of equal workmanship: the town thanked the houses of Tarbessa for their punctual deliveries and would be punctual in its turn; the register would come to rest when it stood true, which was, he was confident, the resting place the creditors of this valley desired for it above all men, their securities being only as good as its word. He sealed it, and heard in the closing of the wax how fluently he had come to speak the language he had ridden up this valley, eighteen months before, unable even to hear; and he entered the exchange in the private book under a line he did not soften: two letters, both courteous, both true, both weapons; the difference is that his cost him nothing.
The thirty days of the notices ran out with the month, and Philon closed the count at the register of appeals: of the one-and-forty hearths served, nine causes entered; six-and-twenty tenancies accepted, the acceptances written out for the unlettered by the scribe at their asking, before witnesses, in the form the law liked; three holdings quit outright, their people gone to the port or over the hills to kin; three silent, whose silence would become, by operation of the law's patience, the worst of the courses by spring. Nine causes. He read them as they were entered, because the spring docket would be his corrections on trial and every cause was a front in the war whose October he had just survived; and the ninth had been entered at the fair, by a scribe of the basilica, on the last day but one of the term: Boutius son of Attenes, of the pagus of the upper vega, for himself and his house, against the voiding of the parcels recorded under M. Fulvius; the cause, that the household holds and has held the said parcels by occupation and improvement through three generations, no rent ever demanded, no Fulvius ever appearing; witnesses of the pagus named, Reburrus first among them.
He knew the land. He had stood on it a year ago in the survey's first October, at a boundary stone with a ghost's name cut on it, while the pagus swore its three noes into his officials' tablets — never seen him, never paid him, never buried him — and he had ridden away that day with the fraud proved another rod's length and had not asked, because it had not then been his question, who did hold the best terrace in the upper vega, or what they held it with, or what a void would weigh on it. Now the question had come to him, in form, with a fee paid out of somebody's margin, and taken its place on the docket for the spring. Three generations against a corrected register. The oldest holding in the vega, asking the racks — after forty years of being lied about in them — to keep it. He put his hand flat on the entry a moment, the way a man holds a leaf down in wind, and could not have said what the hand intended; and took it off, and signed the register closed for the day.
That night the month would not reduce, and he entered it anyway, in the flat style, which was the only style that did not lie about such months. The account of October: a ferry mended that was not broken; lighters honestly engaged elsewhere; berths lawfully slow; credit called by careful men from carefree ones, every demand the better founded because the register is truer; a letter of perfect courtesy, mentioning the town's bread only so that nothing should come as a surprise; a sealed case gone down the river, weighing what petitions weigh. Against all of it, in thirty days, not one act I could relate to any court in this province. I have been at war for a month. I can prove the war only by its costs. My enemy's weapons are patience, prudence, and the law; the law is mine; he has had the use of it all October and never once touched it.
Below that, small, in the space the book kept for findings:
There is one man at war in this valley. Everyone else is only being careful.
